Specific Situation - Divorce without Cause becomes one with Cause

Okay, I'm struggling with this one.

A friend of mine has been going through a divorce that began as "irreconcilable differences". It has been going on for a year now but hasn't officially gone through. So, NOW the divorce has become an issue of unfaithfulness as well, which scripturally releases my friend (but she isn't a "Christian" and was planning on divorce without proper cause anyway).

The problem is that she doesn't want to re-file the divorce papers for the new "reason" because it would start the whole process over again and it's already set to be final this weekend.

The question: Is she scripturally free or still bound?

This should not be filed under 'Spiritual Discussions' it should be filed under 'Extremely Difficult Spiritual Discussions'. In the realm of Divorce and Remarriage it seems that a lot of people have difficulty determining what is right and wrong because there are so many things to consider and personal feelings are so involved. I think I've heard some say that those who get divorced for the wrong reason and sit and play the waiting game (to see who is unfaithful first) then neither has a right to get married. I think we sometimes try to over analyze this and really get a way from the point. However, IF a spouse really was unfaithful but they FILED the divorce as an 'irreconcilable differences" and the government recognized the divorce then does that mean that God only sees the divorce the same way..??? I do not believe that is the case. However, this is a thing that really needs all the facts and someone who has studied it more than us probably.
